Simplifying Florida's Probate Proceedings

In Coral Gables and throughout Florida, a large percentage of estates will have to go into probate. Probate is the court-supervised process where the decedent's assets are identified, debts are paid, and any remaining assets are distributed to the beneficiaries. Under Florida law, there are two types of probate proceedings and these include formal administration and summary administration, with summary administration being the simplified version of the two.

Probate is a necessary process to pass ownership of the decedent's probate assets to his or her beneficiaries. If the decedent left a will, it will be ineffective unless the will passes through probate court; therefore, one can understand the importance of probate. Probate is also necessary for ensuring that the decedent's financial affairs are resolved after his or her death.
